Terms of Service
This is a draft. It has not had legal review yet and will change before Hecate launches. Highlighted text still needs filling in.
These terms are an agreement between you and [LEGAL NAME OF OWNER OR COMPANY] ("Hecate", "we", "us") about using the Hecate app. By creating an account, you agree to them. If you don't agree, please don't use Hecate.
Hecate is not medical advice
Hecate supports movement, rest, and coping through the menopause transition. It is not medical advice, diagnosis, or treatment. Talk to a qualified healthcare professional about your symptoms and before starting anything new.
Nothing in Hecate is a substitute for a doctor. If you think you may be having a medical emergency, call your local emergency number.
Moving safely
Hecate includes physical exercise. Exercise carries some risk of injury, and you choose whether and how to take part. Go at your own pace, stop if something hurts, and check with a healthcare professional first if you have an injury or health condition. To the extent the law allows, you take part at your own risk.
Who can use Hecate
You must be at least 18 years old and able to agree to these terms. You're responsible for your account and for keeping access to the Apple or Google account you sign in with.
Subscriptions
- Some of Hecate is available free. Continued use requires a subscription, monthly or annual, at the price shown in the app before you buy.
- You buy through the App Store or Google Play, and their payment terms apply.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Cancel in your App Store or Google Play settings; you keep access until the end of the period you've paid for.
- Refunds are handled by Apple or Google under their policies.
- If we change the price, the store will tell you before it applies to you, and you can cancel.
Deleting your Hecate account doesn't cancel a subscription. Cancel it in the store too.
Our content
The cards, audio, scripts, artwork, and design in Hecate belong to us or the people we license them from. We give you a personal, non-transferable licence to use them in the app for your own non-commercial use. Please don't copy, resell, or redistribute them.
Using Hecate fairly
Don't try to break, reverse-engineer, or overload Hecate, get into other people's accounts, or use it for anything unlawful.
Changes to Hecate
We add new content and change the app over time. We may also change or end features. If we ever stop offering Hecate altogether, we'll give reasonable notice.
Ending your account
You can delete your account at any time in Settings, or without the app. We may suspend or close an account that breaks these terms, after telling you why where we reasonably can.
Disclaimers
Hecate is provided "as is". We work to keep it running well, but we can't promise it will always be available or free of errors. [LEGAL REVIEW: warranty disclaimer wording.]
Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid for Hecate in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you. [LEGAL REVIEW]
Governing law
These terms are governed by the laws of [STATE], United States. [LEGAL REVIEW: dispute resolution.]
Apple
If you downloaded Hecate from the App Store, these terms are between you and us, not Apple. Apple isn't responsible for Hecate or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms who may enforce them. [LEGAL REVIEW: Apple's minimum terms for a custom licence agreement.]
Changes to these terms
If we change these terms, we'll update the date at the top. For significant changes, we'll tell you in the app before they take effect.
